The following Terms and Conditions of Sale (hereafter: the “Terms of Sale”) apply to product purchases by parties acting in a professional capacity (i.e. non-consumers) effectuated through the website b2b.nimbl.cc and constitute a sales agreement between the a professional party, hereafter known as you, your, partner or customer, and the company, Nimbl, registered as:

Terms of Sale
The following Terms of Sale apply to sales by Nimbl to parties acting in a professional capacity (e.g. shoe retailer) effectuated through www.b2b.nimbl.cc (hereafter: the “Web Shop“). These Terms of Sale explicitly do not apply to sales transactions between Nimbl and consumers, to which a separate set of terms and conditions of sale apply. Please read these Terms of Sale carefully before using our Web Shop and placing any orders. By approving an order, or any other part of the Web Shop, you confirm that you accept these Terms of Sale. These Terms of Sale may be updated by Nimbl from time to time in the future. Any new products or services which are added to the current Web Shop shall also be subject to the Terms of Sale. We reserve the right to update, change or replace any part of the Terms of Sale at any time. It is your responsibility to read this page periodically for changes. When you continue the use of our Web Shop constitutes the acceptance of the changes.
Nimbl selects customers to be part of its non-exclusive dealer network, to act as resellers of its products. Nimbl may appoint other dealers or sell directly in the territory of the customer.
General conditions
We value your trust and therefore pay special attention to your privacy. Please refer to our Privacy Policy for more information, that can also be found on our website. We may refuse service to anyone, at any time, for any reason.
You acknowledge that any content you submit—excluding credit card details—may be transmitted without encryption and could pass through various networks or be adapted to meet the technical requirements of those systems.
Dealer obligations
The customer shall promote and sell the products within the designated territory in a professional and responsible manner. They must maintain sufficient knowledge of the brand and its market positioning to represent it effectively. All promotional and sales activities should adhere to Nimbl’s brand guidelines. Additionally, the customer is expected to maintain an appropriate level of stock and ensure adequate customer service capacity to meet demand.
Nimbl obligations
Nimbl shall supply the products under the agreed commercial terms. Nimbl will provide the customer with up-to-date product information as it becomes available. Where reasonably possible, Nimbl will maintain consistent product quality and availability.
Orders
Orders must be made in writing, via our Web Shop. The Web Shop is intended for sales to our partners in our retail network only only, with the use of a personal login. You are invited to this portal by Nimbl and this account cannot be shared. If you are below the age of 16 you must have parental approval before submitting any order through this portal. A binding purchase agreement is established when your order has been confirmed by us. Nimbl reserves the right to cancel an order if fraud is suspected.
We reserve the right to limit the sales of our products to any person, region or jurisdiction. We also reserve the right to decline any order you place with us. We do this case-by-case. We furthermore reserve the right to limit quantities of any products that we offer. We reserve the right to discontinue any product at any time. If we make changes to or cancel an order, we may attempt to notify you using the email address, billing address, or phone number provided at the time of purchase.
You agree to provide current, complete, and accurate information for all purchases made through our Web Shop. You also agree to keep your account details—such as email address, credit card information, and expiration dates—up to date to ensure we can process your orders and contact you if necessary.
The Web Shop allows you to place orders, according to the most recent Nimbl sales strategy. Once you have selected the desired products, you can check out. Upon checking out, you will be requested to pay either a 30% deposit on the total value of the order, or the full amount of the order. Without receiving this deposit (or full amount), the order will not be processed (and production and/or collection will not start).
Shipping costs that are initially shown, are an estimate and are subject to change depending on the shipping method, location and carrier.
After confirmation of the order - we need at least 1 week to plan your order. Once the order has been confirmed, we give you an estimated lead time. No rights or obligations can be derived from this estimation and is subject to change at any time.
Once you have placed your order and your payment has been received, you will receive a binding order confirmation via e-mail (hereafter: the “Order Confirmation“). Your order will now be processed and the products will be made in our factory in Italy. After finalization of production, we pick your order and package the products (subject to availability) for shipment. When your order is ready for delivery, you are requested to pay the outstanding remaining value of the order (and the shipping costs associated with this order).
Minimum Order Quantities
Customers are required to meet a minimum order quantity of 21 pairs of shoes. There is a minimum order quantity of 5 pairs of shoes for fill-in orders, which ensures efficient use of resources and cost-effectiveness.
Order Modification
If you need to modify details of your order, such as shipping address or size, please get in touch as soon as possible by reaching out to our sales department. Please note that modifications are only possible, in case of availability of materials and production time.
Once orders are complete, modifications are not possible.
Pricing
The prices at the Web Shop are current prices and may be changed at any time without notice. Nimbl is not bound by price indications in the Web Shop which the buyer must reasonably or apparently understand are incorrect and which, for example, have occurred due to technical problems in the web platform or rates that have been manipulated by the customer. Prices are inclusive of local VAT and are payable in the currency indicated at the Web Shop. For non-EU customers, additional VAT, customs charges and other levies may be incurred by your local Customs Authority on your import, at applicable rates.
Prices displayed in the Web Shop exclude shipping costs. The shipping fees shown at checkout are estimates and may vary. The final shipping cost will be based on the carrier’s most up-to-date rates at the time your order is confirmed and ready for shipment.
Payment
Payment can be made by credit card (Visa, Mastercard, Discover, American Express, etc), debit card, PayPal, or wire transfer. Where payment is subject to validation and/or authorization by a card issuer or bank or to credit validation, any Order Confirmation is subject to such validation or authorization. We co-operate with an authorized payment service provider (PSP), who processes your personal details in accordance with the international security standard PCI DSS, developed by international credit card companies such as VISA, MasterCard and Diners. All transactions will be sent through SSL (Secure Sockets Layer) in encrypted form and all card details and payment information will be protected and processed with a high level of security.
Payment terms: 30% to confirm the order, balance upon shipment. If we don't receive the prepayment within 10 days, the order will be cancelled.
When costs are associated with the use of credit cards, these costs will be on the account of the customer.
Invoicing
All orders are invoiced in euro (EUR), in accordance with legal requirements for companies based in Italy. The invoice is issued once the products are ready for shipment and also serves as the delivery document.
Prices may be displayed in other currencies. The final invoice amount in EUR is calculated based on the most current available exchange rate at the time of invoicing. While we aim to use accurate and up-to-date rates, no rights can be derived from the displayed prices in other currencies. We reserve the right to adjust the applied exchange rate without prior notice.
Promotions and discount codes
All campaigns with reduced/discounted prices are limited in time. Multiple offers cannot be combined. A discount code or voucher is only valid once per customer and per purchase. In case of obvious misuse of offers, such as multiple use of coupons and promotion codes, Nimbl reserves the right to cancel the order in question.
On orders eligible for a gift or discount the value of the gift/discount is considered as a general discount on the total amount of the order. If part of or the entire order is sent back for exchange or refund the value of the returned merchandise is recalculated and the purchase price minus the overall discount will only be credited. Promotions and discount codes are only valid on new orders and cannot be applied retrospectively.
Product Deviations
We disclaim liability for any apparent typos on our website, Web Shop and/or in these Terms of Sale. We are not responsible if information made available on this site is not accurate, complete or current. We reserve the right to change products and/or product descriptions at any time without notice. While we aim to provide as accurate as possible descriptions and images on our website and the Web Shop, there may be minor color variations between the images and the actual products sold by us, due to a number of factors such as the color contrast configurations of your internet browser or computer monitor. All pictures are therefore to be seen as illustrations and are not guaranteed to reproduce the exact appearance of a product.
Production and Delivery
We always aim to deliver your order as soon as possible. Once your order is placed, it is not possible to request a refund for the deposit.
Delivery
We offer worldwide shipping with transit times ranging from five to ten business days, after the order has been fully produced and paid. Shipping costs to your location will be specified at the order summary step prior to submitting your order to the Web Shop and such costs will be for your account. All orders are sent using tracked services such as UPS, FedEx, or DHL.
- Shipping Destinations: We ship our products globally, ensuring partners can access our shoe collections in various regions.
- Order Processing Time: All orders will be processed (and planned) within 10 business days after confirmation, ensuring efficient handling and timely shipment of products.
- Shipping Methods: We utilize reliable shipping carriers to ensure fast and safe delivery of our products, with options for standard and expedited shipping based on partner preference.
- Shipping Costs: Shipping costs will vary by destination and total order weight, and detailed shipping fees will be calculated at checkout for clarity. Shipping costs to your location will be specified at the order summary, when you are requested to pay the outstanding amount (circa 70%) of the total value of the order. Such costs will be for your account.
- Customs and Duties: Partners are responsible for any customs duties, taxes, or fees incurred at the destination, making them aware of potential additional costs.
- Tracking Information: Once an order is shipped, tracking information will be provided via email to ensure our partners can monitor the status of their shipments in real-time. All orders that are sent are using tracking services such as UPS, FedEx or DHL.
- Damaged or Lost Shipments: In the event of damaged or lost shipments, partners must report the issue within 3 business days of receipt to facilitate claims and resolutions. All risk of loss or damage to the orders shall pass to you once the order has been collected from Nimbl’s factory and or warehouse by the carrier. - International Shipping Compliance: We adhere to all international shipping regulations, ensuring compliance with export and import laws specific to each region.
- Reception of the goods: It is the responsibility of the recipient to make sure that the products can be delivered at the given shipping address.
- Customer Support: Our customer service team is available to assist our partners with any shipping inquiries or issues, ensuring that all concerns are addressed promptly and effectively.
Collection Points
If shop delivery is unsuccessful, your package will potentially be held at a collection point and you will be notified via email. Failure to collect your package by the date specified will result in non-delivery and return to Nimbl. Costs associated with this will be on your account.
Non-delivery
For EU customers, in the case of non-delivery, we reserve the right to withhold return shipping costs from the refund amount.
For non-EU customers, in the case of non-delivery, please be advised we reserve the right to withhold return shipping costs in addition to (re-)import duties.
Lost Packages
Orders are sent with a track and trace feature and are insured with carriers such as UPS, FedEx, and DHL. If you believe your package has been lost in transit please visit our Contact Page and select the topic ‘Order Status’. In the case that the package is deemed lost, Nimbl will reship or refund the order. We’re sorry for the inconvenience this may cause.
Customs and Duties
Please be advised that Customs and duties may be owed on orders destined outside the European Union. These charges are the responsibility of the recipient and must be paid upon delivery. Refusal of duties and subsequent non-delivery can result in additional re-import fees. Nimbl reserves the right to withhold return shipping and re-import fees.
Damaged, defective, or incorrect orders
Please inspect your order upon receipt. If you find shipping damage, items that don’t correspond to your order, or a manufacturing defect, please visit our contact Page and select the topic ‘Order Status’ within 3 business days of receiving your package. Include a description of the issue, photos that demonstrate the issue, and your order number.
Crash Replacement
We offer a crash replacement policy to consumers on footwear within 1 year from purchase from our Web Shop or one of Nimbl’s retail partners. This crash replacement is only applicable for shoes and only for the same size of the shoe. Any suspicion of fraud will be registered in our systems.

Warranty
First owner consumers are granted a warranty on Nimbl shoes of 2 years from the date of purchase (either through the Web Shop or through a retail partner). We guarantee to the first owner consumer (to be registered at nimbl.cc upon purchase) that our products are free from manufacturing defects affecting form, fit, and function.
Our guarantee does not cover defects resulting from negligence, misuse, unauthorized customization, repairs, or incorrect installation of hardware (such as cleats). Additionally, any defects arising from maintenance procedures not advised or approved by us are not covered under this warranty.
All warranty claims are subject to approval by Nimbl. Warranty of Limited Editions is subject to availability. Normal wear and tear is not covered by our warranty. For claims on components of the BOA Fit System, you may contact BOA directly to request a repair kit.
Partner Responsibilities in the Warranty Procedure
- Communication: partners must provide clear warranty information to the end consumer at the point of sale.
- Claim Handling: partners are responsible for handling initial warranty claims and inquiries from consumers. Partners should evaluate claims based on the warranty coverage described and forward eligible claims to Nimbl.
- Documentation: Ensure the collection and submission of necessary documentation, such as proof of purchase and pictures, to support warranty claims.
- Evaluation: partners should perform a preliminary evaluation of the product to determine if the claim falls within the warranty coverage.
- Submission: Eligible claims should be submitted visiting via our Contact Page and selecting the topic ‘Warranty’. Please include a description of the issue, photos demonstrating the issue, and your order number.
- Resolution: Upon receipt of a valid warranty claim, Nimbl will repair or replace the product as deemed appropriate. Decisions on repair versus replacement will be at the discretion of Nimbl.
- Costs: Nimbl will cover costs related to repairing or replacing warranted products. Partners may be responsible for certain shipping or handling fees.
- Return Policy: Products returned under warranty must follow the Nimbl return procedures to qualify for warranty service.
Please be advised that you may be requested to return your item(s) to Nimbl for a full inspection in order to confirm the defect. In that case, please note the following:
- If the item is used, please remove cleat hardware and personal in-soles or orthotics and ensure the item is thoroughly clean prior to shipping.
- If the warranty claim is approved, we will either repair or replace the product free of charge. Subject to availability and depending on the model, you may receive an updated version of the product.
- If the warranty claim is not approved we will provide a clear explanation of how the determination was made. If you wish to have the item returned to you, we will provide a quote for shipping and handling.
Personal data
By submitting an order at the Web Shop you acknowledge that consent to us processing your necessary personal data is being collected and used for the execution of the agreement and our legitimate interest, including but not limited to your name, address, email address, and phone number.
The provided personal data will be used for the processing and delivery of orders and returns, to execute payment orders and refunds, providing information about our products and services. Your purchase may involve the collection and processing by us, or by a sub-contractor of us, of your personal data, for example of the data you fill out in the order form, including your civic registration number as the case may be, or the personal data processing that may be necessary to execute your payment.
We will use your personal data to manage your purchase (including with respect to payment, delivery and any returns and/or refunds), for marketing purposes and to improve the services and design of the Web Shop. Your personal data may be transferred by us to certain selected third parties involved in e.g. payment transactions or deliveries.
Your personal data will be stored not longer than necessary for the purposes for which they were collected or as required by applicable laws and regulations. only for as long as is needed or for as long as is provided by law.
Upon your request, we will tell you which personal data about you we are processing and for what purpose(s) and you may request that your personal data is corrected or removed. In case you wish to be removed from any direct mailing lists, please contact our Customer Service (support@nimbl.cc).
We take appropriate technical and organizational measures to protect personal data against unauthorized access, loss, destruction, or alteration. Also, we will not sell your personal data to any third party for such third party’s marketing campaigns or for any unsolicited marketing unrelated to your purchase(s) at the Web Shop.
You have the right to access, correct, delete, or transfer your personal data. For requests regarding personal data, you can contact us via support@nimbl.cc.
Disclaimer
We don’t guarantee that product ordering and related services from Nimbl will always be uninterrupted, error-free, or delivered exactly on time. We also can’t ensure that the results you get from using our platform will always be accurate or dependable. At times, we may suspend or stop parts of our service without prior notice.
You use Nimbl’s product ordering and services entirely at your own risk. Unless we specifically state otherwise, everything we provide is offered “as is” and “as available,” with no guarantees—express or implied—regarding quality, performance, or fitness for a particular purpose.
Nimbl, along with its team, partners, and service providers, is not responsible for any loss, damage, or claims arising from your use of our products or services. This includes, but isn’t limited to, lost profits, lost data, replacement costs, or other indirect or incidental damages—even if we’ve been advised they could happen. Where local laws limit the exclusion of such liability, our responsibility will be restricted to the maximum extent permitted.
While we aim to provide accurate and up-to-date information, we do not guarantee that the content on this site is complete, current, or free from error.
